These Terms of Service ("Terms") govern your access to and use of the Chip & Dough website (chipanddough.com) and the purchase of our baked goods. By accessing our website, placing an order, or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

1. Acceptance of Terms

By using this website, you confirm that you are at least 18 years of age or have the consent of a parent or legal guardian. You agree to comply with and be bound by these Terms, our Privacy Policy, and our Cookie Policy, which are incorporated herein by reference. We reserve the right to modify these Terms at any time, and your continued use of the website after any changes constitutes your acceptance of the updated Terms.

2. Products & Ordering

Chip & Dough operates on a preorder model. All cookies are baked fresh to order and are not available for immediate walk-in purchase. When placing an order, please note:

  • All product descriptions, images, and ingredients listed on our website are presented as accurately as possible. However, slight variations in appearance may occur due to the handcrafted nature of our products.
  • Product availability is subject to change. Seasonal items and limited-edition flavors may only be available during certain periods.
  • We reserve the right to limit order quantities or refuse orders at our discretion.
  • Placing an order constitutes an offer to purchase. Your order is not confirmed until you receive an order confirmation from us.

All prices are listed in United States Dollars (USD) and are subject to applicable taxes.

3. Payment & Pricing

Payment is required at the time of placing your order. We accept payment through the secure payment methods listed at checkout. By providing payment information, you represent and warrant that:

  • You are authorized to use the payment method provided.
  • The payment information you supply is accurate and complete.
  • You will pay the total amount due, including any applicable taxes and fees.

We reserve the right to adjust pricing at any time. Any price changes will not affect orders that have already been confirmed. In the rare event of a pricing error, we will notify you and provide the option to proceed at the correct price or cancel your order for a full refund.

Sales tax will be applied as required by Florida state law.

4. Pickup & Delivery

Chip & Dough currently offers local pickup in the Daytona Beach, Florida area:

  • Standard pickup windows are on Fridays and Saturdays, by appointment only.
  • During holiday seasons, additional pickup days may be available and will be communicated at the time of ordering.
  • You will receive a confirmation with the exact pickup location and time window after placing your order.
  • Orders that are not picked up within the designated window may be forfeited without refund.

Local delivery options may be available for select areas and qualifying order sizes. Delivery availability, fees, and scheduling will be presented during the ordering process when applicable.

5. Cancellations & Modifications

Because our cookies are baked fresh to order, we require advance notice for any changes:

  • 48 hours or more before your scheduled pickup: You may cancel or modify your order for a full refund or credit. Contact us at hello@chipanddough.com.
  • Less than 48 hours before pickup: Cancellations and modifications may not be possible, as ingredients may have already been purchased and preparation may have begun. Refunds within this window are issued at our discretion.
  • Custom and large orders: Custom orders (e.g., wedding cookies, corporate gifts) may have different cancellation timelines, which will be communicated at the time of order confirmation.

If we need to cancel your order due to unforeseen circumstances (ingredient unavailability, emergencies, etc.), we will notify you as soon as possible and provide a full refund.

6. Allergens & Dietary Information

Important Allergen Disclaimer: All Chip & Dough products are prepared in a home kitchen that handles common allergens including but not limited to:

  • Wheat / Gluten
  • Eggs
  • Dairy (milk, butter)
  • Tree nuts (pecans, almonds, etc.)
  • Peanuts
  • Soy

While we take care to minimize cross-contamination, we cannot guarantee that any product is free from allergens. If you have a severe food allergy, please contact us before ordering so we can discuss your specific needs. Allergen information is provided for each product listing.

By purchasing our products, you acknowledge and accept the risk of allergen exposure. Chip & Dough is not liable for allergic reactions resulting from the consumption of our products.

7. Intellectual Property

All content on the Chip & Dough website — including text, graphics, logos, images, photographs, recipes, and design elements — is the property of Chip & Dough or its content suppliers and is protected by United States and international copyright and trademark laws. You may not reproduce, distribute, modify, display, or create derivative works from any content on this website without our prior written consent.

The Chip & Dough name and logo are trademarks of Chip & Dough and may not be used without permission.

8. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Chip & Dough provides its website and products on an "as is" and "as available" basis, without warranties of any kind, either express or implied.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our website or products, including but not limited to loss of profits, data, or goodwill.
  • Our total liability for any claim arising from or related to our services shall not exceed the total amount you paid to Chip & Dough in the twelve (12) months preceding the event giving rise to the claim.
  • We are not responsible for delays, failures, or issues caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, supply chain disruptions, or power outages.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not apply to you in full.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Volusia County, Florida. You agree to submit to the personal jurisdiction of these courts and waive any objections based on venue or inconvenient forum.
